F1 Visas: Unmarried Sons/ Daughters
U.S. citizens may apply for F1 immigrant visas on behalf of their unmarried foreign national sons and daughters by filing a Form I-130 Immigrant Petition with USCIS. Children of the principal beneficiary may qualify for derivative immigration benefits on the same I-130 petition if they are unmarried and under the age of 21.
Note: If the beneficiary gets married, the visa class of the petition will be automatically converted to F3 by providing a notarized copy of the beneficiary’s marriage certificate and the spouse’s birth certificate to the National Visa Center.
